Third Circuit in Walsh v. Bank of America Revives ADA “Regarded As” Claim, Says Record of Plaintiff’s Voluntarily Self-ID as Disabled Vietnam Veteran Is Relevant Evidence
This troubling decision by the Third Circuit puts federal contractors on alert to ensure that demographic information obtained from applicants and employees as a result of voluntary self-identifications is kept subject to strict controls regarding disclosure.
