Responding to Charges of Employment Discrimination
As part of our ongoing effort to keep EEAC’s training seminars up-to-date and responsive to our members’ needs, EEAC has created a new training program that combines the long-standing core program Investigating & Responding to Discrimination Charges with the recent special seminar on Writing Effective Position Statements.
This two-day seminar builds upon
the overview of EEOC discrimination charge processing presented
in the Basic EEO training seminar. It is designed primarily
for employer representatives who have direct responsibility
for investigating and responding to discrimination charges filed
with federal and state EEO agencies. The program focuses on
techniques and strategies for dealing with discrimination charges,
from the moment an employer receives notice that a charge has
been filed with an EEO agency, through the final resolution
or referral of the case to litigation. The program includes a special segment on the use of mediation in resolving
both formal and informal charges and an expanded component on preparing an effective position statement and strategies for responding to other agency information requests. Using lectures, discussion
problems, and role-playing exercises, the course is intended
to increase the skills of employer representatives at each stage
of the EEO charge process.
The course offers up-to-date information on enforcement agency procedures, including a full description of EEOCs charge handling procedures. The agenda for the session includes the following topics:
Overview of charge processing procedures;
Current agency policies;
What to do when a charge is filed;
Assessment of the charge;
Time-filing requirements and deferral procedures;
Employers internal investigation;
Effective interviewing techniques;
Developing the employers response;
The fight or settle decision;
Preparing written position statements and responses to requests for information;
Preparing for an EEOC on-site investigation;
Approaching settlement and conciliation;
Predetermination settlements;
Failure of conciliation; and
The mediation option.
The course will be held at the EEAC Training Center, which is located in downtown Washington, DC at 1501 M Street, N.W., Suite 400, just three blocks from the McPherson Square/White House Metro stop. If your travel contemplates an overnight

of the Training Center. Attendees are responsible for making

Seminar Materials: Attendees will receive a reference manual entitled Investigating
and Responding to Discrimination Charges. The manual contains
step-by-step guidance and practical advice on all phases of
the charge-handling process and is heavily cross-referenced
to pertinent EEOC regulations, policy statements, and compliance
manual provisions.
During the program, attendees will work extensively with a series of discussion problems, role plays, and other training exercises designed to highlight effective charge-handling techniques and key strategy considerations.
