Ninth Circuit Rules in Rocheleau v. Microsemi Corporation That Allegations of OFCCP Noncompliance Do Not Support Whistleblower Retaliation Claim

The normally employee-friendly appeals court refused to agree with a plaintiff’s arguments that her reporting of alleged noncompliance with OFCCP regulations was statutorily protected activity for purposes of supporting her whistleblower retaliation claims brought under the federal Sarbanes-Oxley and Dodd-Frank financial reform laws.
