Agreeing With Arguments in Brief Filed by CWC, Unanimous Supreme Court Rules in Digital Realty v. Somers That Dodd-Frank Whistleblower Retaliation Coverage Is Conditional on Employee Filing Complaint With the SEC

A unanimous Supreme Court has ruled that the term “whistleblower” as used in the 2010 Dodd-Frank Wall Street Reform Act – defined as anyone providing “information relating to a violation of the securities laws to the Securities and Exchange Commission” – is “unequivocal.” In so ruling, the Justices rejected an attempt by the SEC itself and several courts to expand that definition beyond its statutory meaning.
