En Banc Ninth Circuit Reverses Long Standing Precedent, Rules in Rizo v. Yovino That Prior Salary Is Not a Legitimate Basis for Justifying Gender Pay Differentials Under the Equal Pay Act

In a decision that was expected, the Ninth Circuit Court of Appeals has ruled that prior salary history cannot be used as an “any other factor other than sex” defense under the federal Equal Pay Act. The ruling widens the split among the federal appeals courts on the issue.
